Abstract

Le droit à la pleine participation des personnes en situation de handicap est une thématique de grande actualité. Dans ce contexte, l’ONU a adopté en 2006, la Convention relative aux droits des personnes handicapées. Cette dernière explicite les droits des personnes en situation de handicap et vise à favoriser une participation active pour tous, dans tous les domaines : politique, économique, social et culturel. Cet article s’intéresse à l’un de ces droits : le droit à l’accès à la culture pour les personnes présentant une déficience intellectuelle. Il met en lumière les enjeux éthiques et difficultés auxquels les professionnels du travail social sont confrontés lorsqu’ils mettent en pratique le respect de ce droit. La réflexion s’ancre dans le contexte législatif et socio-culturel helvétique.

The right of full participation of people with disabilities is a highly topical issue. In this context, the United Nations have adopted in 2006 the Convention on the rights of persons with disabilities. This convention clarifies the rights of persons with disabilities and tries to foster the active participation for all and in all domains : political, economical, social and cultural. This article focuses on one of these rights: the right of access to culture for people with intellectual disabilities. It draws the attention to ethical questions and to the various obstacles social workers have to face when they put that law into practice. The reflection is rooted in the Swiss legislative and socio-cultural context.
